These Terms of Service ("Terms") govern your use of nemesiscostumes.co.nz (the "Site") and any purchase you make from us. Nemesis Costumes is a company registered in New Zealand, trading as "Nemesis Costumes". By using the Site or placing an order, you agree to these Terms.
## 2. Who Can Use This Site
You must be at least 18 years old, or have the consent of a parent or guardian, to place an order with us. By ordering, you confirm the details you provide are accurate and that you're authorised to use the payment method provided.
We sell adult and kids' costumes for New Zealand customers only. Products are drop-shipped directly from our suppliers in Australia — we don't hold local stock. Product photos and descriptions are provided by our suppliers and are as accurate as we can make them, but colours, sizing and packaging may vary slightly from what's shown.
All prices are listed in NZD and include GST where applicable. We reserve the right to correct any pricing errors, even after an order is placed — if this happens, we'll contact you before processing your order and you can choose to proceed at the corrected price or cancel for a full refund. Payment is processed securely at checkout; we don't store your card details.
Placing an order is an offer to purchase, which we may accept or decline (for example, if an item turns out to be unavailable from our supplier, or if we suspect fraud). If we can't fulfil your order, we'll let you know and refund any payment taken in full.
## 6. Shipping & Delivery
Shipping costs, timeframes and tracking are covered in our Shipping Policy. Because we drop-ship from Australia, delivery can take longer than a locally-stocked NZ store — please check the Shipping Policy for current timeframes, especially around peak periods like Halloween.
Your rights if an item is faulty, damaged, or not as described are set out in our Refund & Returns Policy, and nothing in these Terms limits your rights under the New Zealand Consumer Guarantees Act 1993.
## 8. Website Content & Intellectual Property
All content on this Site — text, images, logos and design — belongs to Nemesis Costumes or our suppliers and licensors, and is protected by copyright and trademark law. You may not copy, reproduce or reuse it without our permission.
## 9. Limitation of Liability
To the maximum extent permitted by law, Nemesis Costumes is not liable for any indirect or consequential loss arising from your use of the Site or your order (for example, loss of enjoyment of an event because a costume arrived later than expected) — except where that loss arises from our failure to meet a guarantee under the Consumer Guarantees Act, which can't be excluded.
## 10. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business or the law. The current version will always be available on this page.
These Terms are governed by the laws of New Zealand, and any disputes will be handled in the New Zealand courts.
